“One is the whole idea of dealing with gun violence. The idea that more children die as a consequence of a gunshot wound of a bullet than any other reason in America is sick. It’s really sick.
“And the fact that the NRA has such overwhelming power — you know, the NRA is the only outfit in the nation that we cannot sue as an institution. They got — they — before this — I became president, they passed legislation saying you can’t sue them. Imagine had that been the case with tobacco companies. How many more people would be dead today if we weren’t able to rein in tobacco companies and the use of tobacco? Well, it’s that way now. We can’t.
“And so, we have to change — there’s a lot of things we can change, because the American people by and large agree you don’t need a weapon of war. I’m a Second Amendment guy. I taught it for four years, six years in law school. And guess what? It doesn’t say that you can own any weapon you want. It says there are certain weapons that you just can’t own. Even during when it was passed, you couldn’t own a cannon. You can’t own a machine gun. (Laughter.) No, I’m serious.
“So what’s the deal with the idea that it’s an absolute — you know, I love these guys who say the Second Amendment is — you know, the tree of liberty is water with the blood of patriots. Well, if want to do that, you want to work against the government, you need an F-16. You need something else than just an AR-15. Anyway.
“The generic point — (laughter) — the generic point I want to make is — and I’m going to end this because I’m bored myself now. (Laughter.)”

“I think it’s critically important that we lock down the — how can I say it? — the sense — the idea that there are more children being killed in America by gunshots than by any other shor- — (inaudible) — it just makes no sense. I own two shotguns. I — I’m not a big hunter, but I used to target shoot.
“But the point I’m making is that the idea that you could drive your car up here, park your car, and if some 14-year-old kid — if you left the key in, it took the car and ran it off the road here and hurt somebody, you’re — you’re civilly liable.
“Well, you should have to lock up your guns. What’s the big damn deal about that? Look at all these — all these — all these kids who have blown people away, large numbers.
“You know, we should be in a position where we have universal background checks. We should be in a position where the idea —
“Look, AR-15s are weapons of war. And — and I think the reason why — and I think it’s going to become clear pretty soon — the reason why: The only industry in America you can’t sue is the — is the gun manufacturers. Imagine if that were the law with regard to — with regard to tobacco. How many people would be dead today, that — are alive because we’ve been able to take on tobacco?
“And so, there are so many things we can do in that area.”

“You go home and tell your mother, father, brother, sister, aunt, and uncle that, ‘Whoa, gun trafficking is now a crime.’ They’re going to look at you like, ‘What are you talking about? It’s always been a crime.’ It wasn’t a crime.
“We did the same thing for straw purchases. That’s when a middleman, who can pass the background check, buys a gun usually for someone who can’t pass the background check. It’s now a federal crime if you do that. (Applause.)
“Well, guess what? You do that now, you go to jail. (Applause.)
“There’s so much more, but the bottom line: If this law had been in place a year ago, lives would have been saved. And it’s in place now, and it is saving lives today. We got it done because of you. Not a joke.
“You all think we’re being nice to you. It’s — (laughter) — you’re tough. (Laughter.) Thank God.
“These weapons don’t have serial numbers. That’s why they like to buy them, so criminals can use them to commit crimes and not leave behind a registration of who owned the weapon.
“It made it harder for people to buy stabilized brief — braces. Put a pistol on a brace, and it ma- — turns into a gun. Makes them where you can have a higher-caliber weapon — a higher-caliber bullet coming out of that gun. It’s essentially turning it into a short-barreled rifle, which has been a weapon of choice by a number of mass shooters.
“We’re making it easier to buy gun locks and other safe storage at gun stores.
“If any one of you drove over the parking lot here today, got out of your car, and left a key in your car, and a kid comes along who’s 13, 14 years old, gets in your car, takes it on a joyride and kills someone, guess what: You’re liable.
“Why should that not be the case if you don’t lock up your weapon? (Applause.) Why should that not be the case? (Applause.) Why is that not required? And most gun owners agree with me. (Applause.)
“We also established a zero-tolerance policy for rogue gun dealers who willfully violate the law. Now, instead of a slap on the wrist, their licenses are revoked.
“You have a lot of gun dealers who are engaged in shady actions. Well, guess what? Used to be they get — they’d get a fine. Now they lose their license to sell. (Applause.)
“Let me say that again: We can’t let that just become another statistic. Guns, the number one killer of children in the United States of America?
“Folks, it’s time once again that we banned AR-15 rifle-style weapon. (Applause.) High-capacity magazines — they’re not only a weapon of war, they’re the single biggest driver of profits for the gun industry. That’s why they’re selling them. Profit, profit, profit. The single biggest.
“But let the ban on assault weapons and high-capacity magazines come back into vogue.

“Today, the U.S. Department of Justice finalized a rule to keep another type of especially dangerous weapon out of dangerous hands – pistols with attached stabilizing braces that turn the firearms into short-barreled rifles.
“The gun industry has recently attempted to circumvent this long-standing federal law by selling stabilizing braces that essentially convert a pistol into a short-barreled rifle.
“The Justice Department is taking action to close this loophole and regulate these pistols with stabilizing braces as the dangerous weapons they are, and make it harder for individuals intending to inflict carnage to obtain these weapons.”

“We equip — we equip our service members with the most lethal weapons on Earth to protect all of us, protect Americans. Butwe require them to receive significant training, extensive background checks, mental health assessments. They have to learn how to lock up and store their weapons responsibly or they get kicked out. But we let any stranger — an 18-year-old — walk in — a 20-year-old — and buy an AR-15.
“That’s why, back in 1994, I took on the NRA and passed the assault weapons ban. For 10 years, mass shootings were down — 10 years in a row since I passed that legislation in 1994 as a chair- — as a senator.
“But in 2004, Republicans let that ban expire. And what happened? Mass shootings in America tripled. Tripled.
“It’s time to ban these. It’s time to ban these weapons. We did it before, and we can do it again.

“And I — the way to sell this — I’d walk through the fishing areas. There’s a lot of lowland swamp area in the southern part of the Delmarva Peninsula.
“And the guys would be fishing, and I was — when I was campaigning to get this done. And they’d say, ‘God darn, Joe, what the hell are you doing taking my gun away?’ And I said, ‘Let me ask you a question.’ I said, ‘How many — when you go deer hunting, how many deer are wearing Kevlar vests?’ (Laughter.) And they’d look at me. I’m — I’m not joking. This is what I — and they’d kind of look at me and g — and I said, ‘And, by the way, if you need 30, 40, 60, up to 100 rounds to fire,’ I said, ‘you’re a danger to yourself, man.’ (Laughter.) And they’d go, ‘Yeah, well, Joe, but they say you’re going to take my gun.’
“But I could only get it passed for 10 years. It had to be reauthorized in 10 years. The Bush administration came into play. And I’m not — I don’t want to pick on the Bush administration because they weren’t all bad, but they — they didn’t have the courage to try to pass it again.
“And guess what? Violent shootings went up seven — seven times what they were.
“There’s a reason why the military takes so long to train somebody. It’s not easy to pick up a rifle or a gun and blow somebody’s brains out in front. More people get killed with their own gun in their home trying to stop a burglar than, in fact, any other cause. Think about that. Because it’s hard to do. It’s a hard thing to do.

“I mean — and I’ll just conclude with this: Look, when I first started doing hearings on the issue of what rational gun laws should be, it was during a period when I was a senator and the death rate was going up. Not that many more people were being shot, but the death rate was up. And when I think of — I’m not sure, I think it was (inaudible) hospital in New York — whatever the largest trauma hospital is.
“And I sat with a trauma doctor, and I asked him — I said, ‘What’s the difference? Why are so many people…’ — and not that many more people were being shot. This is now 20 years ago, or 25 years. I said, ‘Why are they dying?’ And they showed me x-rays. He said, ‘A .22-caliber bullet will lodge in the lung, and we can probably get it out, may be able to get it, and save the life. A 9mm bullet blows the lung out of the body.’
“So the idea of these high-caliber weapons is of — there’s simply no rational basis for it in terms of thinking about self-protection, hunting. I mean, I just — and remember, the Constitution, the Second Amendment was never absolute. You couldn’t buy a cannon when the Second Amendment was passed. You couldn’t go out and purchase a lot of weapons.
“And those who — not many are saying it anymore, but there was a while there where people were saying that, you know, the Tree of Liberty is watered with the blood of patriots, and what we have to do is you have to be able to take on the government when they’re wrong. Well, to do that, you need an F-15, you know? Or you need an Abrams tank.
“I mean — so, it’s just — as I say, I think thing — I think things have gotten so bad that everybody is getting more rational about it. At least that’s my hope and prayer.
“I’ve got Gold Star moms in there, so I got to go in.”

And a guy standing said, ‘You want to take my gun?’ I said, ‘I don’t want to take your gun.’ He said, ‘Well, you’re telling me I can’t have more than X number of bullets in a — in a — in my gun.’ And I said, ‘What — do you think the deer you’re hunting wear Kevlar vests? “And, by the way — it’s going to sound bizarre — I support the Second Amendment. You have a right. And so what happens is, I’ve gotten ATF — Alcohol, Tobacco, and Firearms — I have them increase their budget and increase their capacity, along with the Justice Department, to go after the gun shops that are not abiding by the law of doing background checks. (Applause.) For real. That’s number one.
“Number two — number two, we’re in a position where you — most of the cities — and I don’t know enough — I think you’ve had a lot of gun violence here in Cincinnati. I think it was up to — what? — how many — how many how dead? Five hundred over a period. Don’t hold me to the number — whatever it was. But my point is, all across the country. And it’s not because the gun shops in the cities are selling these guns. They are either shadow gun dealers and/or gun shops that are not abiding by the law.

But things we know about: Background checks for purchasing a firearm are important; a ban on assault weapons and high-capacity magazines — no one needs to have a weapon that can fire over 30, 40, 50, even up to 100 rounds unless you think the deer are wearing Kevlar vests or something; community policing and programs that keep neighborhoods safe and keep folks out of trouble.
“First, we discussed cracking down, as you heard from the Attorney General, on rogue gun dealers. We know that if there is a strict enforcement of background checks, then fewer guns get into the hands of criminals. Background checks have thus far kept more than 3 million guns out of the hands of felons — convicted felons, fugitives, domestic abusers, and others prohibited from being able to purchase a gun. And there are still too many loopholes in that system.
“And, today, enough rogue gun dealers feel like they can get away with selling guns to people who aren’t legally allowed to own them.
“And I might add: The Second Amendment, from the day it was passed, limited the type of people who could own a gun and what type of weapon you could own. You couldn’t buy a cannon.
“Those who say the blood of lib- — “the blood of patriots,” you know, and all the stuff about how we’re going to have to move against the government. Well, the tree of liberty is not watered with the blood of patriots. What’s happened is that there have never been — if you wanted or if you think you need to have weapons to take on the government, you need F-15s and maybe some nuclear weapons.
“The point is that there has always been the ability to limit — rationally limit the type of weapon that can be owned and who can own it.
“The last time we had data on this issue of who is purchasing guns was more than 20 years ago. Five percent of gun dealers — it turns out, in the study we did — showed that 90 percent of illegal guns were found at the crime scenes sold by 5 percent of gun dealers. Five percent sold 90 percent of the guns found at crime scenes.
“And the — these merchants of death are breaking the law for profit. They’re selling guns that are killing innocent people. It’s wrong. It’s unacceptable. And as the Attorney General said, we’re going to crack down on those gun dealers and the violent criminals they knowingly arm.
“Talk to most responsible gun owners and hunters. They’ll tell you there’s no possible justification for having 100 rounds in a magazine of a gun. Like I’ve said before: What do you think, the deer are wearing Kevlar vests?
“Responsible gun owners will tell you that there are too many people today who are able to buy a gun but shouldn’t be able to buy a gun.”

“Another thing: Let’s authorize the Violence Against Women Act, which has been law for 27 years. (Applause.) Twenty-seven years ago, I wrote it. It’ll close the — the act that has to be authorized now will close the “boyfriend” loophole to keep guns out of the hands of abusers. The court order said, “This is an abuser. You can’t own a gun.” It’s to close that loophole that existed.
“You know, it’s estimated that 50 women are shot and killed by an intimate partner every month in America — 50 a month. Let’s pass it and save some lives. (Applause.)
“And I need not — I need not tell anyone this, but gun violence is becoming an epidemic in America.
“The flag at the White House was still flying at half-mast for the 8 victims in the mass shooting in Georgia when 10 more lives were taken in a mass shooting in Colorado.
“And in the week in between those two events, 250 other Americans were shot dead in the streets of America — 250 shot dead.
“I know how hard it is to make progress on this issue. In the ’90s, we passed universal background checks, a ban on assault weapons and high-capacity magazines that hold 100 rounds that can be fired off in seconds. We beat the NRA. Mass shootings and gun violence declined. Check out the report in over 10 years. But in the early twe- — 2000s, the law expired, and we’ve seen daily bloodshed since. I’m not saying if the law continued, we wouldn’t see bloodshed.
“More than two weeks ago in the Rose Garden, surrounded by some of the bravest people I know — the survivors and families who lost loved ones to gun violence — I laid out several of the Department of Justice a- — actions that are being taken to — impact on this epidemic.
“One of them is banning so-called “ghost guns.” These are homemade guns built from a kit that includes directions on how to finish the firearm. The parts have no serial numbers, so they show up at crime scenes and they can’t be traced. The buyers of these ghost gun kits aren’t required to pass any background check. Anyone, from a criminal or terrorist, could buy this kit and within 30 minutes have a weapon that’s lethal. But no more.
“And I will do everything in my power to protect the American people from this epidemic of gun violence, but it’s time for Congress to act as well. (Applause.)
“Look, I don’t want to become confrontational but we need more Senate Republicans to join the overwhelming majority of Democrat colleagues and close the loopholes requiring a background check on purchases of guns. We need a ban on assault weapons and high-capacity magazines. And don’t tell me it can’t be done. We did it before, and it worked.
“Talk to most responsible gun owners and hunters. They’ll tell you there’s no possible justification for having 100 rounds in a weapon. What do you think — deer are wearing Kevlar vests? (Laughter.) They’ll tell you that there are too many people today who are able to buy a gun but shouldn’t be able to buy a gun.
“These kinds of reasonable reforms have overwhelming support from the American people, including many gun owners. The country supports reform and is — and Congress should act.
“This shouldn’t be a red or blue issue. And no amendment to the Constitution is absolute. You can’t yell “Fire!” in a crowded theater. From the very beginning, there were certain guns, weapons, that could not be owned by Americans. Certain people could not own those weapons ever.
“We’re not changing the Constitution; we’re being reasonable. I think this is not a Democrat or Republican issue; I think it’s an American issue.”

“But no amendment — no amendment to the Constitution is absolute. You can’t yell crowd — you can’t tell [yell]* ‘fire’ in a crowded movie theater and call it freedom of speech. From the very beginning, you couldn’t own any weapon you wanted to own. From the very beginning that the Second Amendment existed, certain people weren’t allowed to have weapons. So the idea is just bizarre to suggest that some of the things we’re recommending are contrary to the Constitution.
“A third change: We want to treat pistols modified with stabilizing braces with the seriousness they deserve. A stabilizing brace — you’re going to (inaudible) — essentially, it makes that pistol a hell of a lot more accurate and a mini-rifle. As a result, it’s more lethal, effectively turning into a short-barreled rifle. That’s what the alleged shooter in Boulder appears to have done.
“I want to be clear that these modifications to firearms that make them more lethal should be subject to the National Firearms Act. The National Firearms Act requires that a potential owner pay a $200 fee and submit their name and other identifying information to the Justice Department, just as they would if they went out and purchased a silencer for a gun.
“Gun violence in America — for those of you who think of this from an economic standpoint listening to me — estimated to cost the nation $280 billion –- let me say it again — $280 billion a year. They said, “How could that be, Joe?” Hospital bills, physical therapy, trauma counseling, legal fees, prison costs, and the loss of productivity. Not to mention the psychological damage done to the children who live in these cities, watching this happen, knowing someone it happened to.
