The federal judge in charge of the Second Amendment Foundation’s challenge of the recently-adopted “new rule” regarding arm braces for pistols has denied a request by the National Rifle Association to intervene in the case.
At issue is the NRA’s desire to secure the same protections of a preliminary injunction secured by SAF and its partners in the lawsuit for all SAF members. U.S. District Judge Jane J. Boyle announced Friday she was not allowing NRA to join in the case, noting in her order, “the NRA knew of the Rule more than a year before it moved to intervene, and the NRA had no basis to assume a nationwide injunction would be issued in this case. Moreover, allowing an intervention under these circumstances risks incentivizing opportunistic ‘injunction shopping’ under the auspices of ‘timely’ interventions to protect a threatened interest. The NRA’s Motion is not timely.”
But SAF founder and Executive Vice President Alan Gottlieb offered a quick solution to disappointed NRA members: Join SAF.
“While we’re certain NRA members are disappointed,” Gottlieb said, “by joining SAF they can get the protection of the judge’s ruling.”
One month ago, Judge Boyle granted the preliminary injunction and then clarified the order by explaining at the time, “The Court confirms that its Preliminary Injunction Order applies to both the Second Amendment Foundation, Inc. and its members.”
Almost immediately, SAF memberships began to skyrocket. Thousands of new members joined the rolls and they are still joining, a source at SAF confirmed.
“For intervention as of right,” Judge Boyle wrote, “the NRA’s motion fails on two independent grounds. First, the Court finds the NRA’s application for intervention is not timely. Second, the Court finds the NRA’s interests are adequately represented by the current Plaintiffs.”
