Texas State Fair
The news concerning the Texas State Fair banning the carrying of all firearms, knives that are prohibited according to state law, which includes clubs, explosive devices, ammunition, chemical dispensing devices, replicas or hoaxes, or other weapons of any mechanisms manufactured is being addressed those who support the Constitution and embrace fundamental rights. After State Senator Mayes Middleton sent a letter requesting an opinion from the Attorney General’s office and Texas Attorney General Ken Paxton authored a press release warning the City of Dallas to ”End State Fair Firearms Policy Unlawfully Infringing on Second Amendment Rights” and threatened to seek injunctive relief and civil penalties, he has made good on that promise. On August 30, 2024, Paxton filed State of Texas v. City of Dallas,
It states: “The exclusion of handguns from the State Fair is an illegal ultra vires act because it exceeds the legal authority of the officials of the City of Dallas.”Attorney General Paxton continues in his lawsuit:
“Tex. Gov’t Code Ann. § 411.209(a) prohibits state agencies or political subdivisions of the state (such as the City of Dallas) from taking any action, including an action consisting of the provision of notice by a communication described by Tex. Penal Code Ann. §§ 30.06 or 30.07, that states or implies that a license holder who is carrying a handgun under the authority of such subchapter is prohibited from entering or remaining on a premises or other place owned or leased by the governmental entity unless license holders are prohibited from carrying a handgun on the premises or other place by Tex. Penal Code Ann. § 46.03 or other law.”
Finally, he requests the court to levy an injunction on the City of Dallas against enforcing the illegal gun ban:
“Plaintiff asks the Court to enjoin the defendants from acting outside their legal authority by banning guns and by allowing the police to arrest people who violate the illegal ban. The Court should also order defendants to perform the purely ministerial act of allowing people to enter the Park while exercising their constitutional right to carry a handgun and should order the police not to arrest people who exercise their constitutional right to carry a handgun.
8.6 In addition, or in the alternative, the plaintiff is entitled to an injunction under the principles of equity and the penal statutes of this state.”

California: The Senate passed these bills: AB2917, which expands upon California’s “red flag” laws; SB53, which prohibits firearm possession in the home unless the firearms are stored in a California Department of Justice-approved locked box or safe; and SB1252, a bill to codify the Office of Gun Violence Prevention. Now the draconian legislation is in the hands of demagogue and career politician Gavin Newsom. The California Governor has never met an anti-Second Amendment mandate that he does not embrace, as he continues his assault on basic rights, while violent crimes surge within the left-leaning state dominated by gun prohibitionist politicians indifferent to the concept of reasonable self-defense. The hypocrisy with Newsom and fellow gun control activist colleagues is that they employ armed security and law enforcement for protection, while relentlessly campaigning to disarm their constituents.
The California Department of Justice (CA-DOJ) is now trying to solve California’s fiscal shortfall on the backs of gun owners. One could see it coming last year when the legislature passed two bills giving the Attorney General the power to increase fees. The August 23rd proposal will increase the current $1.00 fee per authorization of the Ammunition Eligibility Check to $5.00.
