RE: Recent Alan Gottlieb’s comments on Massachusetts Att. General gun bans.
“Attorney General Healey has declared war on guns,” Gottlieb said. “Her goal is to eliminate gun ownership. What we need is a ban on assault politicians who do not respect constitutional rights.”
Yikes! AG Healey imagines herself smarter than the Framers of this nation and this state!
In the Massachusetts Constitution is Art. 4 of the Declaration of Rights that commands, that any right not secured by Massachusetts, shall be secured by the USA Congress assembled.
So, a simple minded person like myself might imagine that the Second Amendment is one of those rights as the Massachusetts constitutional assembly DEMANDED a Bill of Rights be added to the Constitution!
What does Mass. AG Healey not understand about Art. 4?
Law ain’t “Rocket Science”!
Further, the US Constitution commands all states under:
Art. 1, Sec 9:Clause 5: No Tax or Duty shall be laid on Articles exported from any State.
Art. 1, Sec 10: Clause 2: No State shall, without the Consent of the Congress, lay any Imposts or Duties on Imports or Exports, except what may be absolutely necessary for executing it’s inspection Laws: and the net Produce of all Duties and Imposts, laid by any State on Imports or Exports, shall be for the Use of the Treasury of the United States; and all such Laws shall be subject to the Revision and Control of the Congress.
So no “tax” or “duty” or “imposts” shall be laid upon any imports or exports on ARTICLES.
Yes, this would include LAYING onerous and unnecessary REGULATIONS upon federally licensed firearms. This is absolutely a “duty” under the guise of being a mere regulation. Does it cost money to comply with the onerous regulations…then it is a DUTY under the meaning used in the US Constitution!
Don’t even get me started on US Const. Art. 4 – FULL FAITH and CREDIT of sister state established rights. An unpaid parking ticket or overdue library books will follow you from state to state, but not your state secured GUN RIGHTS!
How about “vested rights” and “Ex Post Facto” laws!!!!!
Massachusetts has been called the “Birthplace of American Liberty”, but I can see where it will be the “Dungheap” of American Rights such that even King George III would envy how rights were destroyed in the name of the Constitution and “public safety”, such “public safety” not even mentioned in the Constitution!
Can you sue the cops if you are a victim of crime????
“NO” says the Supremes in 59 US 396 (1855)…which is SETTLED LAW!
If only the most onerous gun control laws were destroyed in court, all lesser gun ban laws would fall for if the most rigid of gun ban laws are unconstitutional and useless, then so too the lesser ones.
And always remember this – your tax dollars are used to create these “regulations” and your tax dollars are used in court to FIGHT for these regulations..etc….
Ooops correction…..”presumed” constitutional regs. and laws!
